5:01 on this thursday morning, thanks for joining us i'm eric thomas. and i'm kristen sze. a fight to stay alive. a boy hit by a fallen tree while camping is in critical condition. officials will be looking into tree inspection records at memorial park. amy hollyfield is at the hospital in palo alto. >> reporter: good morning. our media partner the mercury news is reporting that this 12-year-old has a crushed pelvis and he's in critical condition. also reporting he is from arizona but he used to live here in the bay area. this happened wednesday

morning, a tree fell on his tent it was about 5:00 yesterday morning. he was in his tent with another 12-year-old boy, a relative. the trip is an annual weeklong family gathering. they were in campsite d-1 at memorial park. campers heard a loud crack followed by screams. >> it was a oak tree, 15 to 20 inches in diameter, 50 to 60 feet tall. there was no wind conditions that contributed to this. >> reporter: the other boy was scraped and bruised but he's okay. investigators say the fallen tree has obvious signs of brown cubicle rot which is common in oaks the county has a program that checks for rotten trees in the spring before campers hit the campsites they north sure if this tree was examined.

they will be checking their records. amy hollyfield, abc7 news. 5: 2 now. this morning san jose police looking for the killer who stabbed a man to death last night. officers found the victim at the corner of east st. johns and north second street he had been stabbed once. paramedics rushed the victim to the hospital where he was pronounced dead. his name has not been released detectives have not found a motive. meantime, police say a suspect in monday morning's double murder of a san jose couple may be in southern california intending to go to mexico. the 31-year-old is believed to be responsible for fatally shooting the couple. it happened in the couple's home in the 300 block of north 7th street. they recently reunited after being separated investigators believe the shooter might have been her ex-boyfriend. the man accused of the

dead -- deadly movie theater shooting rampage may have mailed a package to the university of colorado. it prompted an evacuation. james holmes may have mailed the package to the school he attended until dropping out last month. neighbors at his apartment building was allowed to return yesterday since the bomb squad cleared his booby-trapped unit. tapes released after the shooting that killed 12. we need rescue inside the auditorium, multiple victims. i got a child i need rescue at the backdoor theater nine, now. >> permission to start taking some of these victims via car. >> in denver, the first memorial service for one of the 12 victims was held. it was for a 51-year-old man

he went to the movie with his two teenaged children. they were able to escape unharmed. survivor of the rampage says he has forgiven james holmes he wants to ask him if he can pray for him. doctors released him from the hospital yesterday. three of the victims say they -- -- the hospital will use donations and charity care funds to cover treatments or waive co-pays for those who have insurance. many of the victims are young and don't have health care benefits. mitt romney is in london right now meeting with current and former heads of the british government. he met an hour and a half ago with former prime minister tony blair.

accident in marin county that sent two young people to the hospital. investigators s an suv carrying students from a surf camp rolled off highway 1 last night. officers were told the 21-year-old driver apparently couldn't negotiate a curve. the suv plunged 150 feet into a ravine. the driver had a cut to his head, one student complained of neck pain. the other three were uninjured. a few hours from now mayor lee will join several other city official tossle great the completion of the city's plan to preserve ocean beach from erosion. they've been working on the master plan for two years. officials say the goal is to preserve the beach from coastal erosion. they want the plan -- the long term future of ocean beach 50 to 100 years out to be set. looks like the coast going to be cloudy.

the bay area are trying to appeal mountain view's approval for a restaurant in that city. chick-fil-a say it treats every person with hahn who are and respect regardless of belief, race, sexual orientation or gender. bay area woman accuse wal-mart of discriminating against disabled customers. as a result exposing them to identity theft. the are for independent living has filed a suit on above of the woman from pittsburgh saying wal-mart has ignored complains that its point of sale machines are not within easy reach of people in wheelchairs these customers have to ask strangers to swipe their cards or tell the cashier their pin number or have them sign their name. i can't see and i have to always ask someone to put my pin number, there's no privacy in that and it takes away from my incidence. >> that's the explanation. a wal-mart spokesperson told

the company vows to fight the lawsuit. airlines raking in huge amounts of money from the fees, top six airlines made more than 12 billion dollars in revenue for things other than tickets. worldwide the amount is 22 billion dollars, a spike of 66% in two years. have you ever stayed in a hotel room and wish you booked somewhere else? new survey finds that the feeling of more and more travelers. the survey found more hotel guests were disappointed with their accommodations than they were last year. the company polled 61,000 travelers. they gave lower marks for amenities like swimming pools, food service and check-in procedures. biggest complain, guests didn't like being charged to use the internet and having wifi that was too slow. jd power says many hotels have cut staffing and raised fees that takes a big toll on your

we are getting word of an accident in east palo alto where a car may have crashed into a house. freeway traffic light, here's a live shot of the bay bridge toll. good morning 5:32 on this thursday morning. thank you so much. that incident that frances was talking about we are sending a crew there we'll have the latest coming up i'm eric thomas. and i'm kristen sze. facebook takes the spotlight on wall street today when the network posts first earnings report as a public company. facebook went public two months bag in a stock offering that caused glitches and saw value fall from its initial price of $38 per share.

the release will be facebook's chance to prove itself to investors that it can continue growing revenue from the ads. on average analysts expect facebook to post earnings of 12 cents per share. the san jose city council will decide next month whether to put half cent sales tax increase measure on the november ballot. the count still will consider the hike at its august 7th meeting. on that day santa clara county officials will consider a 1/8 hike for the -- 1/8 cent hike. san jose's sales tax rate would jump to 9.25% one of the highest in the country. this morning san francisco's city attorney will remind consumers they might be eligible for a refund if they got a payday loan.

only two months remain for people to register to be part of the seven million dollar settlement. it stems from a city lawsuit in 2007 against payday lenders who unfairly targeted low income borrowers through high interest rates. people who received a short term loan from 2005 to 2007 may be eligible for a refund. consumers have until october 1st, to make a claim. latest on the colorado move think -- movie theater massacre the university once attended by the againman confirms it received a package three days after the shooting sent by james holmes and contains a notebook with vivid descriptions of his planned attack. some victims showing compassion towards the shooter. a man shot three times says he forgives holmes. >> he's a lost soul right now. i just pray the lord can find his way into his heart and change him. >> i'm so thankful that he did

not kill himself or be killed. i want him alive >> three hospitals are showing their compassion, they will limit or wipe out the victims' medical bills. sad ending to a story we've been following. rangers at the national forest in the sierra have found the body of a missing san rafael hiker. 31-year-old tom hang last seen sunday afternoon he set out on a day hike reported missing. teams searched for hang but found no sign of him until yesterday. the national park service is investigating the circumstances of his death but say foul play does not appear to be involved. cable car gripman and conductor recovering they suffered minor injuries when a suspected drunk driver hit their cable car at powell and geary streets in union square. none of the passengers with

were hurt. police took the suv driver into custody. they say he looked to be intoxicated. big rig driver is okay after apparently driving his truck into a tree in san francisco. it happened around 1:30 this morning. fire crews worked to pull big branches of the tree often big rig. firefighter -- firefighters grinded up branches to free the truck, no reports of injuries. in oakland, city councilman is expected to announce today that he plans to ditch the fruitvale district seat he has held for 20 years instead challenge at large seat in november. he wants to move out of his crime ridden neighborhood and was thinking about leaving city hall all together last year. some say he would have a hard time beating kaplan the only openly gay member who has high favorable ratings and strong support.

valleys. by 4:00, you can see how stubborn the clouds are, santa cruz sunshine 68. mid 60s to near 70 around the bay shore, mid to upper 70s inland. 7:00 just about everybody in the 60s, save napa, fairfield and antioch around 70 upper 50s along the coast into san francisco. tomorrow a lot like today, a long time about noon for us to see sun around the bay and inland and won't see much sunshine at the coast temperatures don't change much. look at how much warmer, four to six degrees warmer saturday and sunday. two slow spots for you. kind of the usual suspects westbound 4 antioch, lone tree towards loveridge, moving around 23 miles an hour, eastbound direction roadwork cleared at loveridge lanes open. the ride through the altamont pass under the speed limit 37 miles an hour. in livermore an accident east stanley boulevard at isabel avenue no injuries reported.

being rescued in a disturbing base of animal neglect. police served search warrants at an apartment and nearby home in seaside and found 113 dead kittens. investigators found 50 urns with cremated remains of more cats all living cats were crammed into the garage and bedroom of the home most were well fed but suffering from respiratory infections and parasites. all are expected to survive. of the rescued cats may been people's pets who were scooped up off local streets. -- >> we are getting calls from people who are hoping that a good outcome can come from this tragic case and they might be reunited with their long lost pet. >> two people who are related live in both homes. the case is being forwarded to the d.a.'s office for possible criminal charges. modesto gas station the focus of protest after an
